TERMS AND CONDITIONS FOR ‘HELLO FROM EARTH’ SUBMISSIONS AND PRIVACY POLICY

If you are under 18 years of age your must obtain the consent or a parent or legal guardian before submitting your Hello from Earth Message.

WHAT INFORMATION DO YOU NEED TO SUPPLY?
When providing your Hello from Earth submission for broadcast you will need to provide us with:

• Your name
• Your location (town or city)
• Your message

These three items are your “Hello from Earth Message”.
You will also need to provide:

• Your email address

Your email address is needed so we can notify you whether your submission has been accepted or rejected. We will also occasionally notify you of developments related to the signal, such as distance traveled, other signals sent to this star system or similar planets in other star systems, and news about other exoplanets discovered. 

Some rules about your submissions:
Your name, location and email address must be genuine. If we think they are not then your submission will be rejected. Your submission may also be rejected if we consider it unsuitable for inclusion in the project (some obvious examples are if the message is profane, offensive or racist). We will not enter into any correspondence with you about the reasons why we have rejected a submission and our decision is final and binding on you. Repeat submissions which are rejected will result in a bar to future submissions.

What we will do with your Hello from Earth message:
If accepted, your Hello from Earth Message will be:

• published on the Hello from Earth website for an indefinite period;
• broadcast beyond planet Earth by radio dish or other means;

You acknowledge that your Hello from Earth Message may be read on our website by people from planet Earth, but may also be intercepted in space or be received by the target planet to which it is beamed, Gliese 581d, or other planets in the Gliese 581 star system.

COSMOS SUBSCRIPTION COMPETITION ENTRIES
If, when providing your Hello from Earth submission, you also ticked the box to be entered into our COSMOS magazine free subscription competition, then the following applies:

• Your free subscription consists of 3 issues of COSMOS magazine over a 6-month period. The minimum value is A$29.85 (Australia/New Zealand) and the maximum value is A$40.45 (International) per 6-month subscription.
• You must provide your residential address so we can send you your subscription.
• You agree that we may contact you twice per year with details of offers and promotions for COSMOS magazine (we will not share your details with third party marketers).
• You agree to our subscription terms and conditions if you are successful in the draw
• Only one entry will be accepted per person.
• The deadline for receiving entries is 5pm Monday 24 August 2009 (Australian Eastern Standard time, or 07:00 GMT August 24), with a maximum of 500 subscriptions to be won. Winners will be announced on the Hello From Earth site on Tuesday 14 September 2009.
• Our decision regarding winners is final and no correspondence will be entered into.
• Winners will be contacted personally by email.
• Subscriptions which we cannot fulfill because we cannot contact you or a residential address is incorrect will be offer to the entrant whose name is next drawn at random
• The prize(s) must be taken as stated and cannot be deferred. There will be no cash alternatives.
• We do not accept any responsibility for late or lost entries due to the Internet. Proof of sending is not proof of receipt.
• Entrants must supply full details as required above, and comply with all rules to be eligible for the prizes. No responsibility is accepted for ineligible entries or entries made fraudulently.
• This prize draw is not open to employees or contractors of Luna Media Pty Ltd or eNerds Pty Ltd, or any person directly or indirectly involved in the organisation or running of the competition, or their direct family members.
• We reserve the right to cancel the competition at any stage, if deemed necessary in their opinion, and if circumstances arise outside of their control.
• Entrants will be deemed to have accepted these rules and to agree to be bound by them when entering this draw.
• These rules are governed by the laws of New South Wales, Australia.
• The subscription is not transferable to another person or organisation.
• If you move address to another country, the subscription is not transferable to that country.

DISCLOSING INFORMATION
We will only disclose personal information in accordance with the Privacy Act (Australia). This means that it will be disclosed if:

• we told you when collecting it that it would be disclosed for that purpose or for a related purpose that you would reasonably expect;
• we have your consent;
• it is part of business assets which we are selling;
• we are required by law to disclose it; or
• it is otherwise permitted under the Act.

OPT OUT
We will provide you with a low-cost way of contacting us if you wish to opt out from receiving further marketing offers. In accordance with the Act, direct marketing offers will contain an opportunity to opt out.

QUALITY OF INFORMATION
We will take reasonable steps to ensure that the information that we collect, use and disclose is accurate, complete and up to date.

SECURITY
We are committed to protecting your privacy and will take reasonable steps to ensure that the information we collect is protected from loss and misuse and from unauthorised access, modification and disclosure.

ACCESS TO THE INFORMATION WE HOLD
You can access your personal information upon request. However, there are occasions when this access may be denied under the exemptions contained in the Act.

AVAILABILITY OF POLICY
These terms and privacy policy will be reviewed from time to time and any amendments will be included in the updated policy.
